Article 11 of Royal Decree 66/2015, of 6 February, regulating the control regime to be applied by AICA, O.A., provided for in Law 12/2013, of 2 August, establishes that the exercise of the control tasks entrusted to AICA, O.A. it will suit one Annual Control Plan.
Control actions
The lines of the Annual Control Plan will be brought to the attention of Advisory Council for its information as a consultative and participatory body of AICA, in which are integrated representatives of the General Administration of the State, of the autonomous communities, of the production and transformation of the food sectors that are interested and of the distribution and consumers.
The Annual Control Plan must be approved by the person in charge of AICA, as well as any addition or modification of the Plan during its execution, which must also be motivated.
It will be developed inPlans of Work(programmes and subprogrammes), which will set out AICA’s inspection activities, which will be reserved and will not be advertised. (Article 11.5 Royal Decree 66/2015, of February 6).
The origin of AICA’s actions may take place in three different ways:
- De job. An initial control sample will be selected according to the criteria established in the Control Plan. In addition, operators, or products not initially foreseen, may be incorporated, motivated by alerts, risks or indications of possible infringements of Law 12/2013, of 2 August.
- by denunciationin accordance with Law 12/2013, of 2 August and the AICA complaints procedure, which will investigate complaints that meet the minimum requirements and elements established to be considered as such, both in Law 39/2015, of 1 October, and in Law 12/2013, of 2 August.
- by transfer of evidence From an autonomous community.
